NFA stands for National Firearms Act . NFA guns (also called Class II and Class III guns) simply put, are fully automatic or select-fire machine guns and submachine guns (MG's), short barreled rifles (SBR), short barreled shotguns (SBS), destructive devices (DD), suppressors (Silencers) and any other weapon (AOW) such as pen guns and cane guns.

 

Although Federal Law provides for citizens to own NFA guns and accessories (having gone through the official process to do so) States are allowed to limit NFA guns. Here is a list to use as a guideline for which states allow various NFA guns and accessories.

 

The process for an individual to purchase an NFA gun includes acquiring a letter of permission from your Chief of Police or Sheriff, fingerprints, photographs and an extensive background check. However...

 

Corporations can purchase NFA guns (in states that allow them) and avoid Chief's of Police and Sheriff's who don't or won't sign off on the letters. When the paperwork to request transfer of an NFA item is initiated by an officer of a corporation a signature from your Chief of Police or Sheriff is not required nor are fingerprint cards and photographs. However this method has a downside since it's the corporation (and not the principal) that owns the NFA item. So, if the corporation ever dissolves, it must transfer its NFA item(s) to the owner (or another buyer) and this occurrence would be considered a new transfer and the process begins all over again. So...

 

The most beneficial was to purchase, own and possess NFA items is through an NFA Trust. With an NFA Trust you have all the benefits of personally owning NFA items with the simplicity and anonymity of being corporate owned and multiple people can be named as trustees and legally be able to possess and use the NFA items.

 

NFA Trusts are often times complicated and very expensive, especially if you go through an attorney.
